Terms and Conditions

Introduction

Hello This is Beriuos (“I” "me" "my").  Thank you for interested in my art commission.

For purposes of these Terms, “you” and “your” means you as "client" "commissioner" "customer"

You are reading the Terms and Conditions (the “Terms”), which govern the relationship and serve as an agreement between you and me are set forth the terms and conditions by which you own my digital artwork.

About this Agreement

Please ensure you read the terms in full. The Terms form a legally binding agreement between you and me. Please take the time to read them carefully.
​Once you’ve commissioned me and completing the payment, you are AGREED to the following rules, Terms and Conditions

If you fail to comply with this Agreement and I do not take immediate action, this does not mean that I am giving up any rights that I may have (such as the right to take action in the future).

 

In changing this Agreement

​

I amend these Terms from time to time, for instance I may or may not notify you that I may change this Agreement.
the changes for example (1) for legal, regulatory, or security reasons or (2) to prevent depravity actions.

I will also update the “Last Updated” date at the top and bottom of these Terms, which reflect the effective date of such Terms.

Rights and Use

​

-  Personal use/Non-commercial use is for an individual's own consumption or enjoyment.

​

- i.ex.: publishing on social media, icons, banners, personal projects, etc.

 ***means that you can't make any profit from my artworks. such as reselling, making as goods, selling as NFT and etc. are prohibited.

​

- Commercial use is any reproduction or purpose that is marketed, promoted, or sold and incorporates a financial transaction.

​

- you must inform this beforehand. the terms will be change depend on our agreements

​

My Rights

​

- I have the right to decline your commission. If I am uncomfortable with the content.

​

- I reserve the right for all my artworks. The work will be used as a portfolio and will be posted online on my sites. (however these files will be lower quality and watermarked). 

​

- I don’t resell commissions. However, in the event that it does happen, I will contact my clients first before proceeding. (but you have full rights to reject this request of mine)

​

- Altering without my permission is prohibited.​ (in case of personal use)

​

- I NEVER ALLOW my artworks to be use as AI training dataset.

​

Your Rights

​

- Please DO NOT claim the commission as you're the artist who drew/painted the work.

​

- however you have the right to claim the theme, composition ideas of the artwork. "IF you propose that said ideas."

​

- If you don't want your commission to be published/displayed, you can inform me beforehand. (This included work in progress/work livestream will not be show publicly.)

​

- you can freely publicly repost the commissions and free to use these commissions for any personal use.​

​

- in the case of commercial use, the terms will be change depend on our agreements

- Crediting is optional but if possible kindly name or link back to my portfolio sites.

Estimate and Deadline

​

 - I  will start working on the commission after I receive the full payment.

​​

- Commissions work time may take about 2 weeks (or more).  

​​

- This depends on the work amounts, complexity and your feedback in each progress.

​​

- Extra fee will be added if the deadline is rushed.

​

Payment

​

**Please, ALWAYS HAVE YOUR PAYMENT/FUNDS READY​

**Payment made in full upon confirming request/order

 

For Foreigner Clients​

  - payments are in USD

  - payment via Paypal/Stripes

​​

For Thai Clients​

  - My base currency is 1 USD = 30 THB 

  - payment via any Thai Local Bank

​

​

Partial payment/Installment plan's condition 

  - Please inform beforehand if you'd like to paying in partials/Installments.

  - Paying in partials/Installments can be made when the commission price is over $250.

  - Lower than $250 Reserve for regular clients or good credit/reputations clients.

Refund Policy

- You are not eligible for a full refund if the commission has been either : started ,finished and has been delivered.

​

- If you choose to cancel your commission during progress, Partial refund will be given depending on the progress of the work that has been done. 

​

- Please understand that I have invested my time and energy into working on your commission request/order. I can not give a full refund on the work I have already worked on.

OTHER NOTICE​​​​

• Please do not send non work/commission related subjects within E-mail/DM except I've finished your order(s). ex. sending meme, video reel, spam, etc.

• Vtuber and Streamer work are count as Commercial works.

• File Delivery will be sent via Email or Drive Link.

• Client, please make sure that you have save/back up the commission file within a week. the drive storage is limited, I hope you understand that.
